1. GENERAL

1.1. The owner of the online store Aroma 89 (hereinafter the online store) is Niel O Ü (registration code 16046197), located in Tallinn. 1.2. These Terms of Use govern the legal relationship between Niel O Ü (Seller) and the person who made the purchase (Buyer) when buying and selling in the online store. 1.3. In addition to these conditions, the legal relationship arising from the sale of goods through the online store is governed by the laws of the Republic of Estonia. 1.4. The seller has the right to change the terms of use of the online store, as well as the prices for goods and services. Changes will be announced in the e-shop environment. The terms and prices applicable at the time of the transaction apply to the transaction. 1.5. Product selection, prices and discounts may differ from the range of products, prices and discounts of the Seller's retail stores. 2. PRICE 2.1. Information about the goods is presented in the online store right next to the goods and includes 20% VAT valid in the Republic of Estonia. 2.2. The prices of the goods are indicated next to the goods in the online store. Delivery fee is added to the price, unless otherwise specified when paying for the goods. Delivery charges depend on the location of the Buyer and the method of delivery. The shipping cost is displayed to the Buyer when placing an order. 2.3. The online store has the right to refuse the purchase and sale transaction and reclaim the goods from the Buyer if the price of the goods in the online store is indicated significantly lower than the market price of the goods due to an error.

3. PLACING AN ORDER 3.1. To order a product, you must add the desired product to the cart. To place an order, fill in the required data fields and select the appropriate delivery method. 3.2. You can change the products and quantities in your shopping cart and remove products from the cart until you pay for the product. 3.3. When you place an order, the screen displays the final price, which can be paid via a bank link or other payment solution. 3.4. The agreement comes into force from the moment the amount due is received on the current account of the online store. 3.5. The Seller will send the Buyer an order confirmation email. If there is no message in your mailbox, make sure it didn't accidentally end up in your spam folder. 3.6. The seller has the right to withdraw from the contract if the ordered goods cannot be delivered due to the end of the goods or for any other reason. The Seller must notify the Buyer of this as soon as possible and immediately, but no later than within 14 days from the date of sending the notification, returns all received payment for the ordered goods (including the cost of delivery of goods). 4. PAYMENT 4.1. The buyer pays 100% prepayment for purchases made in the online store. 4.2. Orders can be paid via Estonian bank links , Pay pal or by invoice. 4.3. Payment takes place outside the online store in a secure environment. The Seller does not have access to the Buyer's bank and credit card details. 5. DELIVERY 5.1. The online store delivers goods throughout Estonia. 5.2. Delivery of goods is carried out in the manner chosen by the Buyer in the online store. 5.3. Shipping costs are borne by the Buyer and related price information is displayed next to the shipping method. 5.4. The seller will send orders within all business days, but no later than within 10 business days after order confirmation. In exceptional cases, the right to deliver the goods within 45 calendar days. The latter include special orders. 6. RIGHT OF RECALL, RETURN AND EXCHANGE OF GOODS 6.1. The Buyer has the right to withdraw from the transaction within 14 calendar days by submitting to the Seller in writing a statement of withdrawal from the purchase of the goods, which is located on the e-commerce alliance page and contains the following information:

6.3. The product returned must include all purchase documentation. Labels affixed to goods and items installed to protect the condition of the goods (such as screen protectors, desiccants, film coatings, etc.), which do not interfere with the inspection and inspection of goods, should not be removed when goods are returned. 6.4. In order to exercise the 14-day right of return, the ordered goods cannot be used otherwise than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing goods in a physical store. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or show signs of use or wear, the Seller has the right to reduce the refundable amount in accordance with the decrease in value or refuse to refund the value. 6.5. Return policy applies to standard sized items. Special orders and customized products cannot be returned. 6.6. The buyer can replace the ordered product within 14 calendar days after receiving it if the size of the ordered product does not fit. Conditions for the return of goods of inappropriate size 6.1-6.5.

6.7. If the item returned to the Seller cannot be replaced due to the lack of the size requested by the Buyer, the Seller must contact the Buyer to propose a solution. 6.8. From the date of submission of the application for refusal to purchase the goods, the Buyer is obliged to return the goods for return within 14 calendar days. 6.9. Until the returned item is accepted, the Seller is not responsible for the item. The return and / or exchange of goods is free of charge, with the exception of the return of transport costs borne by the Buyer. If the defective product has been handed over to the Buyer, the costs of the return are borne by the Seller. 6.10. Upon receipt of the returned goods, the Seller must immediately, but no later than 14 days after receiving the notice of withdrawal, return to the Buyer all fees received from the Buyer on the basis of the contract, including shipping costs. If the Buyer has clearly chosen a delivery method other than the cheapest conventional delivery method offered by the Online Store, the Seller is not obliged to refund the Buyer the cost in excess of the cost associated with the usual delivery method.

6.11. The seller reserves the right to defer payment until the goods that are the subject of the contract have been returned. 6.12. The Seller has the right to refuse the purchase and sale transaction and demand the return of the goods from the Buyer if the price of the goods in the online store is significantly lower than the market price of the goods due to an error. 7. RIGHT TO SUBMIT A COMPLAINT 7.1. The Seller is responsible for non-conformity or defect in the goods sold to the Buyer that already existed at the time of delivery and occurred within two years from the date of delivery to the Buyer within the first six months. The seller is responsible for rebutting the respective presumption. The Seller is not responsible for defects arising after the delivery of the goods to the Buyer. 7.2. If a discrepancy in the product or defects in the product is found, the Buyer undertakes to notify the Seller immediately, but no later than within 2 months from the discovery of the discrepancy, by sending the relevant information to elni.store@gmail.com. com or in writing to Kihnu 16 Tallinn. 7.3. In the event of a discrepancy or defect in the goods, the Buyer has the right to demand repair or replacement of the goods with a corresponding and serviceable product or return the goods at the expense of the Seller. 7.4. The Buyer has the right to demand a reduction in the purchase price of the goods or termination of the contract and the recovery of the amounts paid for the goods, if: the Seller cannot repair or replace the goods, or the product cannot be repaired or replaced, or - the Seller has not eliminated the defect within a reasonable time. 7.5. If a non-conforming product is returned, the Buyer will be reimbursed the amount paid for the item, together with the shipping costs, to the bank account indicated by the Buyer, at the latest within 14 days. The Seller has the right to postpone the refund of the amounts paid until the Buyer returns the goods to his possession.

7.6. The costs associated with the repair or replacement of the thing shall be borne by the Seller within the first six months from the date of transfer of the thing to the Buyer. For the next 1.5 years, the relevant costs will be borne by the Seller only if the claim is justified. The Seller does not reimburse the costs incurred by the Buyer in the event of non-conformity or defects in the goods, and is not responsible for them if: - The value of the goods has decreased / the goods are damaged due to the fault of the Buyer; - Disadvantages have arisen due to the use of the product for other purposes, i.e. as a result of non-observance of the operating instructions; - The cost of the product has decreased due to normal wear and tear under normal use; - There is no copy of the proof of purchase. 7.7. In the event of a disagreement between the Buyer and the Seller regarding product defects, the Buyer has the right to file a claim with the Seller, indicating his name and contact details in writing or reproducible form, the date of the complaint, the product defect and its preferred solution. The Seller must respond to the Buyer's claim in writing or in a form that can be reproduced in writing within 14 calendar days. If the Buyer has complaints about the online store, they must be sent to elni.store@gmail.com . 7.8. If the Buyer and the Seller do not come to an agreement on the dispute, the Buyer has the right to apply to the Consumer Dispute Committee of the Estonian Consumer Protection Board for out-of-court settlement of the dispute. The conditions of the procedure can be found and applied here ( https : // www . Tarbijakaitseamet . Ee / et / tarbijavaidlused - k committees). The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the Buyer and the Seller. Consideration of a buyer's complaint in the commission is free. Disputes in Estonia are resolved by the Consumer Protection Board in accordance with the laws of the Republic of Estonia. The buyer can refer to the European Union Consumer Dispute Resolution Platform. ( https : // ec . europa . eu / consumers / odr / main / index . cfm )

7.9. In case of disagreement with the decision of the Commission, the parties have the right to apply to the county court at the location of the Buyer. 8. PROCESSING OF PERSONAL DATA 8.1. The controller of personal data is Niel O Ü (registration code 16046197) located in Tallinn.
